J19/276/2004, unique registration code 16264602 (hereinafter referred to as "SPECTRUM CENTER"), phone number 0266 24 28 18 or through the contact form available here.

This document establishes the terms and conditions of use of this website and the conditions of purchase of the products and services sold through this website (hereinafter referred to as the "Terms and Conditions"). The Return Policy, SPECTRUM CENTER Privacy Policy, as well as any other documents referred to herein, are part of the Terms and Conditions. By accepting the Terms and Conditions, you also agree to the Return Policy, SPECTRUM CENTER Privacy Policy, as well as all other documents mentioned herein. If you do not agree to the Terms and Conditions, please do not use this website.

Please read the Terms and Conditions carefully before using this website and placing any orders through it. SPECTRUM CENTER reserves the right to modify the Terms and Conditions at any time. 1.1 Definitions

The Terms and Conditions shall apply to all sales of goods/products, as well as services marketed by SPECTRUM CENTER through its website, http://espc.shop/. Within the Terms and Conditions, the following terms shall have the following meanings: 

Buyer - any corporate entity and individual who, by placing an order: (i) online on this website or (ii) by telephone, acts for purposes other than those specific to its commercial or professional activity, having, according to the law, the status of consumer.

Seller - SPECTRUM CENTER.

Online Order - the online request submitted by the Buyer, by going through the necessary technical steps, for the purpose of purchasing Products marketed online, under the conditions provided in the Terms and Conditions, by SPECTRUM CENTER.

Telephone Order – the telephone request submitted by the Buyer, by going through the necessary technical steps, for the purpose of purchasing Products and/or Services marketed online, under the conditions provided in the Terms and Conditions, by SPECTRUM CENTER.

Order – means both the Online Order and the Telephone Order together.

Products - any goods marketed by SPECTRUM CENTER on this website, requested by the Buyer through the Online Order or Telephone Order, to be completed by the Seller, under the conditions provided in the Terms and Conditions.

Service - any service marketed by SPECTRUM CENTER on this website, requested by the Buyer through the Telephone Order, to be provided by the Seller, under the conditions provided in the Terms and Conditions.

Contract - the contract concluded by the Buyer, in accordance with the Terms and Conditions expressly accepted by it, and SPECTRUM CENTER.

1.2 Intellectual Property Rights

In accordance with the Privacy Policy, the content and materials published on the Site are the exclusive property of SPECTRUM CENTER. The use, without the express consent of SPECTRUM CENTER, of any material published on this website, is punishable by law. The name SPECTRUM CENTER and the corresponding graphic representation are registered trademarks of the SPECTRUM CENTER GROUP. The provisions of this section, as well as the applicable provisions of the Privacy Policy, do not prevent you from using this website to place an Online Order and to copy/use/print its details or those of the Contract.

1.3 Processing of Personal Data

SPECTRUM CENTER is registered with the National Authority for the Supervision of Personal Data Processing as a personal data operator under number .......

Your personal data is processed for the purpose of electronic commerce, advertising, marketing and advertising, as well as for the execution of the Contract. SPECTRUM CENTER may send newsletters and other commercial information, strictly in accordance with the legal provisions, only after obtaining your express consent in this regard.

In accordance with the provisions of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, Law no. 506/2004, and Law no. 190/2018 on the processing of personal data and the protection of private life in the electronic communications sector, SPECTRUM CENTER and/or, as the case may be, persons authorized by it have the obligation to process your personal data safely and only for the specified purposes.

By completing the specific forms on the Site, for creating an account, submitting an Order, etc., you expressly consent to the processing of your personal data by SPECTRUM CENTER and/or, as the case may be, by persons authorized by it, for the specified purposes.

According to the law, you have the following rights, namely the right to be informed, the right of access to data, the right of intervention, the right of opposition, the right not to be subject to an individual decision, the right to appeal to the courts in case of violation of your rights by SPECTRUM CENTER. You also have the right to request at any time the total or partial deletion of personal data, as well as the cessation of their processing for direct marketing, advertising, and publicity purposes. You can exercise the rights listed above by submitting a written request, signed and dated, sent to the SPECTRUM CENTER headquarters.

Refusal to provide the data requested by SPECTRUM CENTER to place an Order will make it impossible for SPECTRUM CENTER to complete the Order, not concluding the distance contract and implicitly making it impossible to deliver the ordered products/services.

In case you modify, through the forms on the website, the personal data already provided to SPECTRUM CENTER and there are ongoing orders, those orders will retain the data from the time of placing the order, and the delivery of the Products will be made without taking into account the new data. SPECTRUM CENTER does not request, by any means of communication (phone/email, etc.), confidential information, personal passwords, etc. In case you disclose such data to third parties, they are fully responsible for their own actions. In such situations, SPECTRUM CENTER will not be liable for any damages.

The online payment of Spectrum Center's products and/or services can be made under full security conditions using a bank card. To ensure the security of transactions, Spectrum Center uses the e-Commerce services provided by [BANK NAME]. To successfully complete the transaction, you must enter the necessary transaction authorization data into the payment platform following the instructions provided by this platform. Spectrum Center does not request or store any details regarding your card.

2. Information about the online SPC service

2.1 Spectrum Center takes all measures to ensure that the information published on the Site, including the description of the Products and Services, as well as the listed prices, is at all times correct and complete. However, mistakes can be made. In such situations, Spectrum Center will try to rectify all errors as soon as possible. In the event that Spectrum Center finds that the respective error has affected/influenced your Order or the valid Contract concluded, it will try to inform you as soon as possible, offering you both the possibility of reconfirming the Order/the Contract, and the possibility of canceling it.

2.2 Please note that purchasing products online offers a different experience than in-store. In particular, you should know that:

• the colors of the Products, as presented on the Site, may be different in reality because they depend on various factors, including, but not limited to, your monitor settings.
• the size and shape of the Products may be different in reality from how they appear in the images available on the Site; however, Spectrum Center provides complete information regarding the dimensions of the Products in the descriptions provided for each Product. Therefore, please note that it is your responsibility to ensure that the actual size of each Product corresponds to the purpose for which you purchased the respective Product.
• the photographs and images on the Site are for illustrative/orientational purposes only. For an accurate description of the Product and the included details, you must carefully read the corresponding description of the Product.
• Products will be delivered only to the extent that they are available, so there is a risk that Spectrum Center may not be able to deliver the Order. Also, Spectrum Center reserves the right to withdraw any Product from sale at any time. In such situations, Spectrum Center's sole responsibility to you is the full refund of the amounts paid for the respective Products that it can no longer supply/has withdrawn from sale, within 14 (fourteen) days (for individuals) or max 30 days (for legal entities).
• Spectrum Center makes every effort to deliver the Products and provide the Services requested by the Buyer in accordance with the assumed delivery/prestige date, mentioned in the email with details about delivery/prestige, sent according to the provisions of section 8. Please note that all information regarding delivery/prestige provided by Spectrum Center (on the Site, by phone, or by email) is only for indicative purposes, and therefore may vary from case to case. Please consult Point 8 for more information about delivery/prestige.
• not all Products on the Site can be purchased through Online Orders or Phone Orders.
• not all online promotions will be available at the Spectrum Center store, and vice versa.
• in principle, the prices practiced online may differ from those mentioned in the Spectrum Center catalog and applied in the stores in Romania. However, occasionally, there may be a difference between the prices practiced online and those in the Spectrum Center catalog or store, for example. Spectrum Center reserves the right to adjust freely and in compliance with legal provisions, the prices and special offers practiced.

2.3 It is not allowed to use this website for the deliberate introduction of viruses or any other program or material that may be technically harmful or destructive. Attempts to gain unauthorized access to this website, the server on which it is hosted, or any other server, computer, or database connected to this website are prohibited. By accepting the Terms and Conditions, you undertake not to attack this website through a denial of service attack or a distributed denial of service attack.

Non-compliance with the provisions of this clause will be reported to the competent authorities for the application of legal sanctions and will immediately result in the suspension of the right to use this website.

Although Spectrum Center makes every effort to ensure safe navigation on its website, it does not guarantee that the Site, the servers on which it is hosted, or the emails sent are free of viruses or other potentially harmful computer components, that they do not contain errors, omissions, defects, delays, or interruptions in operation or transmission, line drops, or any other similar factors. Please note that you use the Site at your own risk, and Spectrum Center is in no way responsible for any direct or indirect damages caused by the use or access/visiting of the Site or as a result of the use of the information on the site. Spectrum Center is not responsible for errors or omissions that may occur in drafting or presenting materials on the Site, without affecting the rights you have under the law as a consumer.

Therefore, it is in your best interest to ensure that you have installed adequate defense systems to protect your computer from viruses and/or any other harmful content.

Spectrum Center reserves the right to cancel Orders for Products and/or Services displayed on the Site due to technical errors or Orders that, due to technical errors, have obviously erroneous/ridiculous prices (prices that can reasonably be considered erroneous/ridiculous by the average consumer), with the consequence of refunding the entire amount paid by the Buyer considering the canceled Orders, if applicable, within 14 (fourteen) days.

Any links to other websites or materials from third parties, if applicable, posted on the Site are provided solely for informational purposes, and Spectrum Center assumes no responsibility for the content of these websites and materials, for the products or services promoted or sold through these websites.

2.4 Spectrum Center has the right, at any time, to modify, suspend, or terminate the online sale of Products and/or Services, in whole or in part, temporarily or permanently, with or without prior notice. Spectrum Center will not be liable for any modifications, suspensions, or interruptions in the availability of Orders, without prejudice to the rights recognized by law to consumers. Also, Orders validly confirmed by Spectrum Center before the operations of modification, suspension, or cessation are properly executed by Spectrum Center.

2.5 Spectrum Center will ensure the confidentiality of your data, including authentication data, password, and all other details related to the account created on the Site, in accordance with the Privacy Policy. However, it is your responsibility to ensure that the information regarding the account created on the Site remains confidential at all times and is not transmitted to third parties. By accepting the Terms and Conditions, you agree to inform Spectrum Center as soon as possible if you have reasonable suspicions that the security of your account is compromised.

2.6 Please note that you can place a valid Order only if you are over 18 years old and you want the Products and/or Services to be delivered/provided in Romania. A valid/active email address and a phone number where you can be easily contacted are necessary.

2.7 The online marketing of Products takes place only on a wholesale basis.

3. Site Registration

If you visit the Site (even if you do not purchase Products or Services), you are considered a user.

To place an online Order:

You register on the Site by creating an account where you can manage your plans and arrangements on the Spectrum Center server. You can access these from any computer in the store, create multiple shopping lists, which you can save, print, or turn into an online order. Note that the account retains the history of online Orders or billing/delivery details.

After creating an account, its activation will only be done with approval from Spectrum Center.

The account will be activated within 48 hours of registration. Spectrum Center may refuse registration if it finds that the provided information is clearly inaccurate.

4. Placing an Online Order

4.1 Registering an online Order constitutes an offer to purchase Products from the Seller, under the conditions set forth in this section.

4.2 Once registered, an online Order cannot be modified ("Initial Order"), except in cases where one or more products are not available in stock, in which case a new order ("New Order") must be confirmed via telephone. The Initial Order is then canceled. Spectrum Center will contact the Buyer to confirm the New Order. This does not affect the Buyer's rights to withdraw from the contract concluded with Spectrum Center.

4.3 After placing an online Order, the Buyer will receive an email with details of the ordered Products, the total cost of the online Order, including delivery and collection costs, and an order identification number.

4.4 Transmitting the online Order by the Buyer and receiving the confirmation email merely confirm that the order has been received by Spectrum Center and do not form a contract with mandatory effect.

4.5 Spectrum Center will make every effort to deliver all Products ordered by the Buyer but reserves the right, without providing reasons, to refuse an online Order. If an online Order is refused by Spectrum Center, the Buyer will be notified as soon as possible.

4.6 The Contract is considered concluded between the Seller and the Buyer as follows:

1. if the Buyer opts for delivery of the Products to Spectrum Center's Work Points, at the time of receiving the confirmation email of the online Order - this moment being considered the acceptance of the online Order.
2. if the Buyer opts for Ex Works delivery of the Products, the Contract is considered concluded at the moment of the Buyer's confirmation of the pickup schedule and acceptance of responsibility for arranging transportation from Spectrum Center's premises.

5. Phone Orders

5.1 Regardless of placing an online order on the Site to purchase Products ("Online Order" as defined in section 1.1 above), the Buyer has the option to place a phone order by calling +40770244138.

5.2 Products and Services (defined in section 1.1 above "Phone Order").

5.3 Steps for placing a Phone Order:

1. Spectrum Center will take the Buyer's order for Services and/or Products over the phone
2. after placing the Phone Order, the Buyer will receive an email (at the email address provided) with details of the ordered Products/Services, the total cost of the Phone Order, including delivery and collection/packaging costs, and an order identification number
3. the Buyer will confirm to Spectrum Center through: (a) phone or (b) email the following: (1) The Phone Order registered is in accordance with the phone discussion, and (2) agreement regarding the payment of the Phone Order
4. Spectrum Center will send the Buyer a payment link via email related to the agreed Phone Order
5. the Buyer will access and make the payment within a maximum of 120 minutes from the dispatch of the aforementioned payment link; otherwise, the Phone Order will be canceled.
6. Spectrum Center will process the Phone Order immediately after payment confirmation.

For the avoidance of doubt, the only method of payment for the Phone Order is as mentioned in section 6.3 points iv. and v. above.

5.4 Products can be ordered by the Buyer under the same terms and conditions applicable to the Online Order regarding prices and delivery.

5.5 The contract is considered concluded at the moment of confirmation by SPECTRUM CENTER, by sending the email in accordance with point 5.2 above, accepting the order submitted by the Buyer.

6. Payment

6.1 Online orders require a 30% advance payment upon order confirmation, with the remaining amount to be paid before loading, in accordance with Ex Works (EXW) terms.

6.2 Unless expressly provided otherwise, all prices indicated in the Order are exclusive of VAT and certification or custom charges.

6.3 Except where otherwise provided in the Terms and Conditions, the total price you will actually pay for the Products ordered and, separately, for the Services requested, is the one indicated by the Seller at the time of placing the Order, prior to its transmission for processing by the Seller.

6.4 The only accepted payment method is bank transfer.

6.5 To ensure transaction security, SPECTRUM CENTER uses services offered by the BANK NAME for bank transfers. No additional commission is charged for such payments. Transactions are carried out in RON, at the exchange rate of the bank issuing your card, in case it is associated with an account in a currency other than RON. SPECTRUM CENTER does not request and does not store any details regarding your card.

6.6 After placing the online Order and upon confirmation, you will be required to make a 30% advance payment. The remaining balance must be paid before loading the Products.

7. Price Errors

7.1 SPECTRUM CENTER will make every effort to ensure that the prices indicated in the Orders section are correct. However, errors may occur. If SPECTRUM CENTER discovers an error related to the price of one or more Products and/or, as the case may be, Services already ordered by the Buyer, the Buyer will be informed of the error as soon as possible. In these situations, the Buyer will have the option to either confirm the Order at the correct price or cancel the Order.

7.2 If the Buyer decides to cancel the Order after being informed of the correct prices of the Products, but has already paid the price of the ordered Products, SPECTRUM CENTER will provide a full refund as soon as possible (but not more than fourteen 14 calendar days from the cancellation).

7.3 To the extent that SPECTRUM CENTER has not informed the Buyer of the incorrect prices, in accordance with the provisions of this section, and has confirmed the Order, the valid Contract will be properly executed, and the Products will be delivered in accordance with Point 8 below.

8. Delivery of Products and Transfer of Risks

8.1 The Seller will arrange for the Products to be made available at its premises or another named place (such as the factory or warehouse) agreed upon between the parties, and will ensure the transmission of accompanying documents.

8.2 Immediately after placing the order, you will receive an email containing the order number and value, payment method, as well as the estimated delivery date. The delivery status can be verified by calling +40770244138 daily, between 08:00 - 17:00, where the order number will be communicated.

8.3 The Buyer shall arrange for the collection of the Products from the Seller's premises or other agreed-upon location within a reasonable timeframe. The Buyer shall bear all costs and risks associated with the collection of the Products from the Seller's premises or other agreed-upon location.

8.4 Upon delivery of the Products, the Buyer shall inspect the Products for conformity and any damage. Any discrepancies or irregularities shall be noted on the relevant delivery document and signed by the Buyer. Failure to sign the delivery document shall constitute acceptance of the Products in their delivered condition.

8.5 Upon collection of the Products, the Buyer assumes all risks associated with the Products, including but not limited to the risk of loss, damage, or destruction of the Products. The Seller shall have no liability for any loss, damage, or destruction of the Products once they have been collected by the Buyer

8.6 Any additional services required for the transportation of the Products from the Seller's premises or other agreed-upon location to the Buyer's premises shall be arranged and paid for by the Buyer. The Seller shall have no obligation to arrange or pay for any transportation services beyond making the Products available for collection at its premises or other agreed-upon location.

8.7 The Seller shall provide all necessary assistance and documentation to facilitate the collection of the Products by the Buyer, including but not limited to providing loading facilities and preparing export documentation if applicable.

8.8 Any delay in the collection of the Products by the Buyer shall not relieve the Buyer of its obligation to pay for the Products in accordance with the agreed payment terms. The Seller reserves the right to charge the Buyer for any storage costs incurred as a result of the Buyer's delay in collecting the Products.

9. Warranty for Products/Services

The products sold online by SPECTRUM CENTER benefit from the commercial warranties provided by SPECTRUM CENTER. All information regarding the warranties of the Products, including but not limited to the terms and conditions of exercise, can be found in the Warranty Certificate or Certificates of Conformity (where applicable).

10. Returns:

10.1 Quality Assurance: We take pride in the quality of our timber and wood materials. In the rare event that the buyer identifies any quality issues or defects upon receipt of the goods, we will work diligently to address the concerns and facilitate resolution.

10.2 Notification of Issues: Any concerns regarding the quality or condition of the goods must be reported to us within 10 days of receipt. Failure to notify us within this timeframe may limit our ability to provide assistance or accept returns.

10.3 Return Procedure: If a return is deemed necessary due to quality issues or other valid reasons, the buyer must obtain authorization from us before returning the goods. Unauthorized returns may not be accepted or processed.

10.4 Return Shipping: The cost of return shipping for authorized returns due to quality issues or defects will be borne by us. However, if the return is requested for reasons unrelated to quality or as a result of the buyer's change of mind, the buyer will be responsible for the return shipping costs.

10.5 Refunds or Replacements: Upon receipt and inspection of the returned goods, we will assess the situation and determine whether a refund or replacement is appropriate. Refunds will be issued in accordance with our refund policy, and replacements will be provided subject to availability.

11. The applicable law and jurisdiction

The use of the Website, the transmission of Orders, and the conclusion of Contracts through the Website are governed by Romanian law.

Any dispute arising from or in connection with the use of the website or in connection with an Order/Contract will be subject to the competent courts in Romania.

Consumers cannot waive the rights guaranteed to them by law. Any contractual clause by which the rights provided by law in favor of consumers are waived or restricted directly or indirectly is not binding on them.
